Terms & Conditions

These Terms & Conditions apply to purchases and private commissions from Dave Drew Fine Art. By placing an order, booking a private commission or purchasing artwork through this website, you agree to these terms.

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

1. About Dave Drew Fine Art

Dave Drew Fine Art creates fine-art photographic dog portraits and finished framed artwork.

The website offers two principal ways to purchase artwork:

Collection Artwork — existing Dave Drew Fine Art portraits available in a choice of sizes and presentation options.

Private Commissions — individually created portraits of a client's own dog, photographed and developed specifically for that client.

2. Collection Artwork

Artwork from the Collection is produced to order and is not normally held in stock.

The customer selects the artwork, size and framing or presentation option available on the website before placing an order.

Every effort is made to represent artwork, frames and finishes accurately. However, colours and tones displayed on screens can vary between devices, and natural materials and frame finishes may show minor variations. Such differences are a normal part of producing physical fine-art pieces.

Alternative sizes, frames or presentation styles may be available by prior agreement.

3. Collection Orders and Payment

Payment for Collection artwork is made in full when the order is placed.

Once payment has been received, the artwork will be professionally produced and framed according to the customer's selected options.

Where an order is placed online using one of the standard Collection options, the customer's statutory cancellation rights apply.

In general, consumers purchasing standard goods online have the right to notify the seller that they wish to cancel within 14 days of receiving the goods and then have a further 14 days to return them. Certain personalised or genuinely custom-made goods are excluded from this right.

Where a customer requests a genuinely bespoke size, frame, finish or other presentation outside the standard options offered, the cancellation position will be explained before the order is confirmed.

4. Private Commissions

A Private Commission involves creating an individual fine-art portrait of the client's own dog.

Before booking, the portrait requirements, intended size, framing or presentation and final price will be agreed.

A 50% advance payment is required to secure the portrait sitting.

The remaining 50% balance becomes payable after the client has selected the photograph to be used and has approved the finished painterly portrait, and before the finished artwork is submitted for professional production.

5. The Portrait Sitting

Portrait sittings are relaxed and unhurried and are conducted using natural light.

Because the work is created outdoors, suitable weather and lighting conditions are important.

Dave Drew Fine Art reserves the right to postpone a sitting where weather, light or other environmental conditions are unsuitable for creating the intended portrait.

Where this happens, every reasonable effort will be made to arrange a mutually convenient replacement date, and there will be no additional charge to the client.

6. Dogs and Safety

The client remains responsible for their dog throughout the portrait sitting.

The client must disclose before the sitting any behavioural or safety issue that could reasonably affect the photographer, other people, other animals or the safe conduct of the sitting.

The photographer may pause or end a sitting if continuing would present an unreasonable risk to the dog, photographer or anyone else present.

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

7. Cancellation of a Private Commission

If a client needs to cancel a Private Commission, they should contact Dave Drew Fine Art as soon as reasonably possible.

Where cancellation occurs sufficiently far in advance of the portrait sitting and no material costs or losses have been incurred, the advance payment will normally be refunded in full.

Where costs have already been incurred or cancellation occurs sufficiently late that Dave Drew Fine Art suffers a genuine loss as a direct result, a reasonable amount may be deducted from the refund to reflect that loss.

Any amount retained will be proportionate to the work undertaken and losses actually incurred, taking into account any reasonable opportunity to reduce those losses.

This approach reflects current CMA guidance that cancellation charges and retained advance payments should represent genuine losses rather than operate as an automatic penalty.

Where cancellation rights are provided by law, those rights take precedence over these terms.

8. Cancellation by Dave Drew Fine Art

If Dave Drew Fine Art needs to postpone a portrait sitting because of weather, illness or other circumstances beyond reasonable control, a replacement date will normally be offered.

If it ultimately becomes impossible for Dave Drew Fine Art to fulfil the commission, payments relating to work or artwork that cannot be supplied will be refunded as appropriate.

9. Creating and Approving a Commissioned Portrait

Following the portrait sitting, the client will be given the opportunity to select the photograph from which the finished portrait will be created.

The selected photograph will then be individually developed into the Dave Drew Fine Art painterly style.

The finished portrait will be presented to the client for approval before the physical artwork is ordered.

Once the client has approved the finished portrait and paid the outstanding balance, the artwork will be submitted for professional printing and framing.

10. Commissioned Artwork Entering Production

Private commissioned artwork is created specifically for the individual client and depicts their own dog.

Once the client has approved the finished portrait, paid the outstanding balance and the artwork has been submitted for professional production, the order cannot normally be cancelled or changed simply because the client has changed their mind.

This does not affect any statutory rights where artwork is faulty, damaged, not as described or where another statutory remedy applies.

Personalised and custom-made goods are generally excluded from the normal change-of-mind cancellation right applying to standard online goods.

11. Production and Quality Control

Finished artwork is professionally produced and framed by a specialist professional laboratory.

Completed artwork is delivered to Dave Drew Fine Art first so that it can be personally inspected before being supplied to the client.

Because each piece is produced individually, production times can vary. Any timescale provided is an estimate unless a specific delivery date has expressly been agreed.

12. Delivery and Collection

Where the client is local to Dave Drew Fine Art, completed artwork may be personally delivered or collected by arrangement.

Where personal delivery or collection is not practical, the finished artwork will be securely packaged and sent to the client.

Standard delivery within the delivery area specified on the website is included in the advertised price unless otherwise stated.

13. Damaged or Faulty Artwork

Every finished piece is personally inspected before leaving Dave Drew Fine Art.

If artwork arrives damaged, the client should contact Dave Drew Fine Art as soon as reasonably possible and provide photographs of the artwork and packaging where possible. This will help the damage to be assessed and any claim with the carrier or supplier to be handled promptly.

Where artwork is faulty, damaged or not as described, an appropriate remedy will be provided in accordance with the client's statutory rights. Depending upon the circumstances, this may include repair, replacement or refund.

Nothing in these terms restricts the client's statutory rights concerning faulty goods.

14. Digital Image Supplied with a Private Commission

A Private Commission includes a digital copy of the finished portrait for the client's personal use.

The client may store the image, display it on personal devices, share it with friends and family, post it on their personal social-media accounts and make prints for their own personal, non-commercial use.

Copyright remains with Dave Drew Fine Art.

The digital image may not be sold, licensed, supplied for commercial or promotional use, used to create products for sale, or otherwise commercially exploited without prior written permission from Dave Drew Fine Art.

The image should not be materially edited, altered or manipulated in a way that misrepresents the original artwork.

15. Copyright

Copyright in all photographs and finished portrait images created by Dave Drew Fine Art remains with the photographer, Dave Drew.

Purchasing a physical piece of artwork transfers ownership of that physical item to the purchaser but does not transfer copyright in the underlying photograph or artwork.

No image may be reproduced or commercially exploited except where permitted by these terms or with prior written permission.

16. Use of Commissioned Portraits by Dave Drew Fine Art

An important part of the Private Commission arrangement is that Dave Drew Fine Art retains the right to display and use photographs and finished portraits created during the commission as examples of the photographer's work.

This may include use on the Dave Drew Fine Art website, portfolio, social-media accounts, exhibitions, advertising, promotional materials and other marketing.

Dave Drew Fine Art also retains the right to offer suitable finished dog portraits created through Private Commissions as artwork within the Dave Drew Fine Art Collection, including offering prints and framed artwork of the portrait for sale to other customers.

By booking a Private Commission, the client acknowledges and agrees to this use.

Any separate use involving identifiable photographs of the client or other people will be considered separately.

17. Artistic Style

By commissioning Dave Drew Fine Art, the client acknowledges that they are engaging the photographer because of the established photographic and painterly style demonstrated on the website and in the portfolio.

Creative decisions concerning lighting, composition, photographic treatment, colour, tone and final artistic finish remain part of the photographer's creative judgement.

The client will have the opportunity to approve their finished commissioned portrait before it is submitted for physical production.

18. Liability

Dave Drew Fine Art will provide photography services with reasonable care and skill and will take reasonable care when handling, inspecting and supplying finished artwork.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded under consumer law.

19. Privacy

Personal information supplied in connection with an enquiry, purchase or Private Commission will be handled in accordance with the Dave Drew Fine Art Privacy Policy.

Personal information will only be used and shared where there is an appropriate lawful basis for doing so, including where necessary to fulfil an order or provide the requested service.

20. Changes to These Terms

The Terms & Conditions applying to an order or Private Commission are those in effect when the contract is entered into.

Dave Drew Fine Art may update these terms from time to time for future transactions. Changes will not retrospectively alter an existing contract unless agreed with the client or required by law.

21. Governing Law

These Terms & Conditions and contracts between Dave Drew Fine Art and its clients are governed by the laws of England and Wales.

Nothing in this clause removes any rights a consumer may have concerning the appropriate jurisdiction for a consumer dispute.
